{"id":1771,"date":"2021-10-07T10:32:56","date_gmt":"2021-10-07T10:32:56","guid":{"rendered":"https:\/\/blackrocklaw.com\/new\/?p=1771"},"modified":"2023-09-19T12:46:05","modified_gmt":"2023-09-19T12:46:05","slug":"firma-presenta-demanda-por-discriminacion-en-nombre-de-kurt-king-y-hamburger-marys-tampa","status":"publish","type":"post","link":"https:\/\/www.businesslaw.blackrocklaw.com\/es\/firma-presenta-demanda-por-discriminacion-en-nombre-de-kurt-king-y-hamburger-marys-tampa\/","title":{"rendered":"Firma presenta demanda por discriminaci\u00f3n en nombre de Kurt King y Hamburger Mary\u2019s Tampa"},"content":{"rendered":"<p><strong>Network: <\/strong>ABC Action News<\/p>\n<p><strong>Attorney: <\/strong>Gil Sanchez, Esq.<\/p>\n<p style=\"text-align: justify;\">HILLSBOROUGH COUNTY, Fla. \u2014 A former franchise owner of popular gay-themed burger restaurants is suing the Florida Department of Health for discrimination in a case involving a local hepatitis A scare.<\/p>\n<p style=\"text-align: justify;\">Kurt King, who owned Hamburger Mary\u2019s Restaurant Bar and Grille in Ybor City, alleges the health department and Dr. Douglas Holt \u2013 Hillsborough County\u2019s public health boss \u2013 \u201ctreat homosexual persons differently as demonstrated by the false reporting of Hepatitis A,\u201d according to the lawsuit.<\/p>\n<p style=\"text-align: justify;\">\u201cWe were definitely targeted for just being LGBTQ,\u201d King told Anchor Wendy Ryan shortly after his lawyer electronically filed the lawsuit in Hillsborough County Monday afternoon.<\/p>\n<p style=\"text-align: justify;\">The civil lawsuit references a public warning issued by the Hillsborough County Health Department in October 2018 about a Hamburger Mary\u2019s worker who tested positive for hepatitis A.<\/p>\n<p style=\"text-align: justify;\"><iframe data-src=\"https:\/\/assets.scrippsdigital.com\/cms\/videoIframe.html?&amp;host=www.abcactionnews.com&amp;title=Hamburger%2520Marys%2520owner%2520claims%2520health%2520department%2520targeted%2520his%2520restaurant%2520for%2520being%2520gay&amp;kw=hamburger%20marys%2Chamburger%20mary%2Chepatitis%20a%2Ceverything%20you%20need%20to%20know%20about%20hamburger%20marys%2Chep%20a%2Chep%20a%20outbreak&amp;uid=6db69afe423c4b7d92763c6928a480ab&amp;purl=\/news\/local-news\/i-team-investigates\/owner-of-hamburger-marys-suing-florida-department-of-health-over-discrimination-allegations-involving-hepatitis-a-scare&amp;story=1&amp;tags=Homepage%20Showcase%2CRegion%20Hillsborough%2CNewsletter%20Showcase%2CNews%2CLocal%20News%2CI-Team%20Investigates%2CNews%20Links&amp;s=wfts\" height=\"100%\" frameborder=\"0\" scrolling=\"no\" allowfullscreen=\"allowfullscreen\" data-mce-fragment=\"1\" src=\"data:image\/svg+xml;base64,PHN2ZyB3aWR0aD0iMSIgaGVpZ2h0PSIxIiB4bWxucz0iaHR0cDovL3d3dy53My5vcmcvMjAwMC9zdmciPjwvc3ZnPg==\" class=\"lazyload\" data-load-mode=\"1\"><\/iframe><\/p>\n<p style=\"text-align: justify;\">But King has accused the agency of false reporting. He previously said lab test results his employee sent him show the hepatitis A test was not positive and shared those test results with Anchor Wendy Ryan during a sit-down interview that aired on ABC Action News in early 2019.<\/p>\n<p style=\"text-align: justify;\">A Dirty Dining investigation earlier this year uncovered the Hillsborough County Health Department never told the public about four other local restaurants with workers who tested positive for hepatitis A during the same time period.<\/p>\n<p style=\"text-align: justify;\">At the time, Dr. Holt told ABC Action News the public had no right to know the names or locations of those other restaurants and insisted hepatitis A cases were more prominent among gay men.<\/p>\n<p style=\"text-align: justify;\">King\u2019s attorney, Gil Sanchez, references that ABC Action News interview in the lawsuit, stating, \u201cDr. Holt made statements to ABC Action News Wendy Ryan that, \u2018If you\u2019re going to fish, you have to go where the fish are.\u2019 and that \u2018\u2026the classic category is men having sex with men.\u2019\u201d<\/p>\n<p style=\"text-align: justify;\">Sanchez told ABC Action News, \u201cThat statement is, in our opinion, direct evidence of discrimination and really at the heart of proving that in fact Dr. Holt utilizing his position of power was discriminating against the company of Hamburger Mary\u2019s.\u201d<\/p>\n<p style=\"text-align: justify;\">Hepatitis A is a food-borne illness that spreads when an infected person does not wash their hands properly after going to the bathroom and then touches food or other objects. Drug users and people experiencing homelessness are the most at risk, according to the CDC.<\/p>\n<p style=\"text-align: justify;\">In the same interview, Dr. Holt also told Anchor Wendy Ryan he had not personally seen the positive hepatitis A test for the Hamburger Mary\u2019s worker but insisted the test results were correct.<\/p>\n<p style=\"text-align: justify;\">King previously owned Hamburger Mary\u2019s restaurants in Ybor City, Brandon and St. Petersburg but closed all three locations by February 2019.<\/p>\n<p style=\"text-align: justify;\">King blamed a sharp decline in business after the health department\u2019s announcement, according to his lawsuit.<\/p>\n<p style=\"text-align: justify;\">ABC Action News reached out to the health department and Dr. Holt for comment on the lawsuit Monday night but have yet to hear back.<\/p>\n<p style=\"text-align: justify;\">Hepatitis A has become an epidemic in the Tampa Bay area and the state with more than 2,000 confirmed cases in Florida since January 2018.<\/p>\n<p style=\"text-align: justify;\">The hepatitis A virus is spread when a person unknowingly ingests the virus from objects, food or drinks that have been contaminated with small undetected amounts of stool from an infected person.<\/p>\n<p style=\"text-align: justify;\">Pinellas County Health Department is offering hepatitis A vaccines to the public at no cost at several vaccine centers.
